Filing for bankruptcy protection under Chapter 13 of the Bankruptcy Code allows an individual to reorganize past due and current debt into a manageable repayment plan that usually lasts three to five years. Although for some clients, a Chapter 7 bankruptcy is more appropriate, a Chapter 13 personal bankruptcy is occasionally beneficial, because it:

• Implements an automatic stay which deters creditors from seeking repayment through litigation
• Stops foreclosure on your home - if you file before the Sheriff's sale
• May allow you to keep your home
• May allow you to keep your car
• May allow you to recover a repossessed vehicle
• May resolve tax problems
• Discharge divorce obligations to pay debts that are not alimony or support (which are not dischargeable in a chapter 7)

Chapter 13 Repayment Plan

Chapter 13 is an unsecured debt consolidation plan which allows you to repay debt over a longer period of time than outside bankruptcy for debts like past due mortgage payments, car payments, tax payments and back support payments. The debtor pays one monthly payment to a trustee who then disburses payments to creditors. The monthly payment is your disposable income, which is the difference between your take home income and your necessary living expenses.
