Filing for Chapter 7 Personal Bankruptcy

If unsecured debt (debt not secured by a mortgage or lien) exceeds forty to fifty percent of your annual income, filing bankruptcy is usually the only option. Under Chapter 7 of the Bankruptcy Code, individuals are able to eliminate significant debt. Although Chapter 7 bankruptcy is also known as liquidation bankruptcy in which property can be sold to pay creditors, most people who file bankruptcy are able to keep all of their property.  However, debtors cannot discharge the following debts under Chapter 7:

  • Past due child support payments
  • Most school loans
  • Some other ineligible debt
  • Some taxes

Who Qualifies for Chapter 7 Bankruptcy?

If an individual's income is below the median income based on the family size and location, the individual will likely be automatically eligible. Individuals whose income is greater than the median income must submit to the "means test" to determine eligibility. Essentially, the individual must deduct reasonable living expenses from their monthly income (according to the previous six months income) and compare to determine whether the client has too much disposable income.  As an experienced Chapter 7 bankruptcy attorney, I can explain the "means test" and help you evaluate your personal situation.
