Stop Foreclosure and Repossession

Filing for personal bankruptcy causes an automatic stay to be ordered. This means that all attempts to collect a debt must immediately stop, including phone calls, letters, lawsuits and garnishments. Additionally, foreclosure proceedings and repossessions must temporarily cease.

  • Mortgage foreclosure: In order to avoid foreclosure on your home, you must file for bankruptcy before the Sheriff's sale of the home. If you are several payments behind on your mortgage, a Chapter 13 bankruptcy repayment plan may be necessary to reinstate the mortgage by catching up on past due payments.

  • Property repossession: Secured property, property held by a lien, such as an automobile, can be repossessed if the payments are not maintained. You can stop repossession of your vehicle by filing for bankruptcy. Additionally, you may recover a repossessed vehicle if bankruptcy is filed prior to the car being sold.
